What does “misconduct in public office” mean in the criminal law of England and Wales? This educational overview explains the four elements described in current Crown Prosecution Service guidance and why ordinary mistakes or poor performance do not automatically establish the offence.
The prosecution must address: • A public officer acting as such • Wilful neglect of duty and/or wilful misconduct • Conduct serious enough to amount to an abuse of the public’s trust • No reasonable excuse or justification
Misconduct in public office is a common-law offence rather than an offence defined in a statute. Whether a person is a public officer, whether conduct was wilful, and whether it reaches the required seriousness are fact-specific legal questions. Other statutory offences may also be relevant in some cases.
